1. Read this first — the short version

Touchstone is a private relationship self-reflection app. You write about your own life and about a person you're in a relationship with, and the app helps you look back over time. Here is the heart of the agreement in plain words. If this summary ever conflicts with the detailed sections below, the detailed sections govern.

  • Touchstone gives you data, not care. It's a tool for your own reflection. Almost everything it shows you is a summary of what you entered. It has no knowledge or insight about you beyond what you put into the app.
  • Touchstone is not a therapist, doctor, counselor, crisis line, or safety service. Using it does not create any professional or care relationship, and it is not a substitute for professional help.
  • Touchstone cannot help you in an emergency. In an emergency, call 911 (or your local emergency number). The app cannot summon help, contact anyone for you, or respond to a crisis.
  • Sage and other AI features generate text automatically. That text can be wrong or off-base. It is not professional advice, and you should not rely on it as advice.
  • Any support resources the app shows are standing information operated by outside organizations. We provide them "as is"; we don't control them or guarantee they'll be available or accurate.
  • Your privacy is governed by our separate Privacy Policy. These Terms don't restate it — see §9.
  • These Terms include an arbitration agreement and a class-action waiver (§17), with a way to opt out. Please read that section.

The rest of this document is the full agreement. It matters, and we've tried to keep it readable.


2. Accepting these Terms

These Terms of Use (the "Terms") are a binding agreement between you and Pathoz LLC ("Pathoz," "we," "us," or "our"). They cover the Touchstone apps for iOS and Android and the Touchstone website, including the no-install pages friends open to read something you've shared and the hosted Friend Consensus room (together, the "Service").

By creating an account, downloading, installing, accessing, or using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

We ask you to accept these Terms and confirm you are 18 or older when you sign up, and we may ask you to accept again if we make a material change (§19).


3. Who may use Touchstone

  • Touchstone is only for adults 18 years of age or older who reside in the United States. By using the Service you represent that you are at least 18 and a U.S. resident. The app asks you to confirm you are 18 or older at sign-up.
  • Touchstone is not directed to children. We do not knowingly collect information from anyone under 18. Touchstone handles sensitive personal information and is never intended for minors. This matches our app-store age ratings and our Privacy Policy.
  • Where the Service is offered. Touchstone is offered only to U.S. residents and is operated from the United States. If you access the Service from outside the United States, some content — including any support resources — may be empty or unavailable, you use the Service at your own risk, and these Terms still govern.

4. What Touchstone is — and what it is not

This section is the spine of these Terms. Read it carefully; the rest of the agreement builds on it.

4.1 Touchstone provides data, not care

Touchstone is a self-reflection tool. You enter your own diary entries, quiz answers, and notes about yourself and about a partner. Almost everything the app shows you — trends, summaries, "Insight Continuums," reflective lenses, counts, and history — is a summary of what you entered. The app has no knowledge or insight about you beyond what you share inside it, and no outside information about you, your partner, or your relationship.

To be accurate about how those summaries are made: the app does run automated software (including classifiers) over your own entries to organize and summarize them — for example, to group an entry by relationship dimension, life domain, or feeling, and to compute your trends over time. This processing works only on what you put into the app, to show you a reflection of your own words. It does not give the app outside knowledge about you, and it is not a clinical assessment, a diagnosis, or a professional judgment about you.

We don't claim the app "never analyzes" your entries — it does, to build your summaries. We claim, and hold ourselves to, something narrower and true: what the app shows you is a summary of what you entered, and the app has no outside knowledge of you.

4.2 No duty of care; the app does not watch over your safety

Touchstone does not undertake to keep you safe, to monitor you for danger, to intervene in your life, or to serve as a crisis or emergency service. It is not a safety-monitoring service, and you must not rely on it as one. Your safety and wellbeing remain yours, and — where you need help — the responsibility of qualified professionals and emergency services.

If the app ever shows you a caution or a list of support resources, treat it as a limited, automated convenience — not a judgment about you, not a professional assessment, not a guarantee that help is or isn't needed, and never a substitute for calling 911 or a qualified professional. The app cannot reliably tell whether you or anyone else is in danger, and it does not take responsibility for your safety. If you are or may be in danger, see §5.

4.3 Not a professional relationship

Using the Service does not create a therapist–patient, physician–patient, counselor–client, coaching, fiduciary, or any other professional or care relationship between you and Pathoz or anyone acting for it. Sage is a software feature — not a person and not a licensed professional. Nothing in the Service is a professional service delivered to you.

Nothing in the Service — including anything you enter, anything the app computes from it, AI-generated text (§6), and any resource list (§5, §12) — is medical, clinical, psychological, or legal advice, a diagnosis, a treatment plan, or a professional recommendation. Always seek the advice of a qualified professional about your health, safety, or legal situation, and do not disregard or delay it because of anything in the Service.

4.5 Sensitive content and personal circumstances

Touchstone handles sensitive personal information — relationship content and emotional state — and may be used by people in difficult or unsafe relationships. We have tried to build and describe the app honestly, without implying that it watches over you. The app does not, and cannot, ensure your physical safety. If you are in danger, please see §5.


5. Emergencies and support resources

  • Touchstone is not an emergency service and cannot help you in an emergency. It cannot dispatch help, contact anyone on your behalf, or respond to a crisis. If you or someone else is in danger or having a medical or mental-health emergency, call 911 (or your local emergency number) right now.
  • The support resources the app may display are standing information, drawn from a fixed list and operated by third parties, not by Pathoz. We provide them "as is," as a convenience. We do not control, operate, endorse, warrant, or guarantee any resource, its availability, its accuracy, its hours, or the outcome of contacting it. We are not responsible for those organizations or for any interaction you have with them (§12).
  • We try to keep listed resources accurate and re-verify them periodically, but we do not guarantee that any number, link, or hours are current.
  • A note if you share a device with someone who monitors it: calls, texts, and visits to a resource may be visible to another person who has access to your device. You know your situation best.

6. Sage and other AI features

  • Some features generate text using artificial intelligence. This includes the in-app reflective assistant sometimes branded "Sage," and may include other AI-powered features.
  • AI output is generated automatically and may be inaccurate, incomplete, or inappropriate. It can misread your situation, invent details, or reflect something back that is simply wrong. It is not professional advice and not a verdict about you or your relationship, and you must not rely on it as professional, medical, clinical, or legal advice (§4.4).
  • Sage does not decide anything for you and does not act on your behalf. It reflects patterns from what you entered; it does not tell you what to do, and it cannot take any action in the world.
  • How your entries are processed to power these features is described in the Privacy Policy, not here. In short: the words are sent to a contracted AI provider without your name, email, or account attached, the provider is contractually barred from training on them, and they are deleted within a short window. The Privacy Policy governs all data handling (§9).

7. Your license to use the app

Subject to your compliance with these Terms, Pathoz grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use one copy of the app on a device you own or control, and to use the Service, for your own personal, non-commercial use.

Except where applicable law expressly permits, you may not: copy, modify, or create derivative works of the Service; reverse-engineer, decompile, or disassemble it; rent, lease, lend, sell, sublicense, or otherwise transfer it; remove any proprietary notices; or use it to build a competing product. You also represent that you are not located in a country subject to a U.S. embargo and are not on any U.S. government prohibited-parties list. All rights not expressly granted are reserved by Pathoz.


8. Acceptable use

You agree not to use the Service to: violate any law; infringe anyone's rights; upload unlawful content or content you have no right to share; harass, threaten, or harm another person; attempt to identify, surveil, or stalk another person; interfere with, disrupt, probe, or gain unauthorized access to the Service or its systems; scrape or harvest data; introduce malware; or use the Service on behalf of anyone under 18.

A note specific to Touchstone. The app is for reflecting on your own life and relationships. It must not be used to surveil, control, or harm another person. Features that reference another person — for example, notes about a partner — are for your private reflection only and must not be used to identify, confront, harass, or endanger anyone.

We may investigate and take action — including suspending or terminating your account — for any violation (§16).


9. Your content, and the license you give us

  • "Your Content" means everything you enter into the Service — diary entries, quiz answers, notes, conversations with Sage, and anything you choose to share.
  • You own Your Content. These Terms do not change your ownership.
  • You grant Pathoz only the license we need to operate the Service for you — to host, store, process, classify, summarize, transmit, and display Your Content for the purpose of providing the Service to you (including powering Sage and, only where you choose, sharing features), as described in the Privacy Policy. This license is no broader than that purpose. Consistent with the Privacy Policy, we do not sell Your Content, use it for advertising, or use it to train AI models.
  • Privacy and data handling are governed by the Privacy Policy, which these Terms incorporate by reference. We do not restate those terms here — please read it. Where these Terms and the Privacy Policy address the same subject (how Your Content is processed, stored, or shared), the Privacy Policy governs.
  • Feedback you send us about the Service may be used by us freely and without obligation to you.

10. Our intellectual property

The Service, and everything in it other than Your Content — including the software, the "Touchstone" and "Sage" names and branding, text, graphics, designs, and the selection and arrangement of content — is owned by Pathoz or its licensors and is protected by intellectual-property laws. Except for the license in §7, these Terms grant you no right in any of it.

If you believe content on the Service infringes your copyright, contact us at legal@pathoz.com with enough detail to identify the work and the material, and we will respond consistent with applicable law.


11. Subscriptions, billing, and renewals

  • Touchstone offers a free tier and paid subscriptions. Tracking any number of relationships, plus the core logging, history, and social features, is free; paid subscriptions unlock additional depth and features. Current tiers and prices are shown in the app before you buy.
  • Billing runs through the app stores. Purchases and subscriptions are processed by Apple (App Store) or Google (Google Play) under their terms and payment methods. Pathoz does not receive or store your full payment-card number.
  • Auto-renewal. Paid subscriptions renew automatically at the then-current price until you cancel. You are charged through your Apple or Google account at the start of each period.
  • Managing and canceling. You manage and cancel subscriptions through your Apple or Google account settings, not through Pathoz. To avoid the next charge, cancel at least 24 hours before the current period ends. Deleting the app does not cancel a subscription.
  • Price changes. If we change a subscription price, the change applies to future billing periods, and you will be notified as your app store requires before it takes effect. Continuing after that means you accept the new price; if you don't, cancel before the next renewal.
  • Refunds are handled under the applicable app store's policies, and by any non-waivable rights you have under U.S. state law.

12. Third-party services

The Service relies on and may link to third parties — including the Apple App Store and Google Play, our infrastructure and AI providers (see the Privacy Policy), and the support organizations referenced in §5. These third parties are not controlled by Pathoz. We do not endorse, warrant, or take responsibility for any third party, their services, their availability, their accuracy, or your dealings with them — all of which are provided "as is" and are between you and that third party.


13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Without limiting §4, Pathoz does not warrant that the Service will be uninterrupted, secure, or error-free; that any summary, trend, AI output (§6), or third-party resource (§5, §12) will be accurate, current, available, or suitable; or that the Service will meet your needs. You are responsible for your own decisions. The Service is a reflection tool — not advice, care, or a safety or emergency service (§4, §5).

Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.


14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PATHOZ AND ITS OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, GOODWILL, OR PROFITS, ARISING OUT OF OR RELATING TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY.

PATHOZ'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID PATHOZ IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (b) US $100.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you, and nothing in these Terms limits liability that cannot be limited under applicable law.


15. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Pathoz and its officers, employees, and agents from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, your violation of any law or third-party right, or Your Content.


16. Ending your account; suspension and termination

  • Your right to stop. You may stop using the Service and delete your account at any time.
  • How to delete. You can delete your account in the app (Settings → Delete account) and from your account page on the web if you can't reach the app. Deletion uses a soft-delete with a 30-day grace period during which you can cancel; after that, your account and diary content are permanently purged (including from backups as they cycle), as described in the Privacy Policy. Some records may be retained where law or legitimate operational needs require, as the Privacy Policy explains.
  • Deleting the app is not the same as deleting your account or canceling a subscription (§11).
  • Our right to suspend or terminate. We may suspend or terminate your access if you violate these Terms or the law, or as needed to protect the Service or other people.
  • Survival. Sections that by their nature should survive termination — including §4, §9§10, §13§15, §17, and §20 — survive.

17. Dispute resolution, arbitration, and governing law

Please read this section carefully — it affects how disputes between you and Pathoz are resolved and includes a class-action waiver.

  • Governing law. These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules, and by applicable U.S. federal law (including the Federal Arbitration Act).
  • Informal resolution first. Before starting a formal dispute, please email legal@pathoz.com with a description of the problem and give us 60 days to try to resolve it. Most concerns can be settled this way.
  • Binding arbitration. If we can't resolve it informally, you and Pathoz agree to resolve any dispute relating to the Service or these Terms by final and binding individual arbitration, rather than in court, except as stated below. Arbitration is less formal than a lawsuit and uses a neutral arbitrator.
  • Class-action and jury waiver. You and Pathoz agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding, and each waives any right to a jury trial.
  • Exceptions. Either party may bring an individual claim in small-claims court, and either party may seek injunctive relief in court to protect intellectual-property rights.
  • Your right to opt out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing legal@pathoz.com with your account email and the statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.
  • Non-waivable rights. Nothing here waives any right you have under applicable law that cannot be waived.

18. App-store terms (Apple and Google)

Your use of the app is also subject to the terms of the store you got it from.

  • Apple (App Store). These Terms are between you and Pathoz only, not Apple, and Apple is not responsible for the app or its content. Your license is limited to use on Apple-branded devices as the App Store terms permit. Apple has no obligation to provide maintenance or support for the app. To the maximum extent permitted by law, Apple has no warranty obligation for the app, and Apple is not responsible for any product-liability, legal/regulatory, or third-party intellectual-property claims relating to the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not in a U.S.-embargoed country or on a U.S. prohibited-parties list.
  • Google (Google Play). If you obtained the app from Google Play, your use is also subject to the Google Play Terms of Service, and these Terms are between you and Pathoz, not Google.

19. Changes to these Terms

We may update these Terms as Touchstone evolves. For material changes, we will provide notice — in the app and/or by email — before they take effect, and where appropriate ask you to accept the updated Terms. These Terms always show a current version and effective date at the top, and continued use of the Service after an update means you accept the updated Terms. We keep prior versions available on request.


20. General terms

  • Entire agreement. These Terms, the Privacy Policy, and any app-store terms are the entire agreement between you and Pathoz about the Service.
  • Severability. If any provision is held unenforceable, the rest stays in effect.
  • No waiver. If we don't enforce a right, that isn't a waiver of it.
  • Assignment. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
  • Third-party beneficiaries. There are none, except Apple and Google as stated in §18.
  • Force majeure. Neither party is liable for delays or failures caused by events beyond its reasonable control.
  • Notices. We may give you notice in the app or by email; you contact us at the addresses in §21.
  • Headings are for convenience only and do not affect interpretation.
